criminal offence if it is proven, beyond any
reasonable doubt, that such offence actually took

Franco Depasquale, sitting in the First Hall of
the Civil Court, held, in the case 'Dr Anthony P.
Farrugia vs the Electoral Commission', that the
First Hall had the power to examine actions taken
by the Electoral Commission and of the Revising
Officer in order to ascertain that they were in
accordance with the General Elections Act, 1991
